NINEVEH — A Prince’s Lakes man faces a felony after police say he left the scene of a motorcycle crash in which one driver was injured May 14.

At around 9 p.m. police responded to the 9600 block of Nineveh Road for a crash that occurred earlier in the day but that had not been reported, a probable cause affidavit by Brown County Sheriff’s Deputy Andrew Eggebrecht states.

One of the men involved told Eggebrecht that he and two other men were riding motorcycles northbound on Nineveh Road when one of them went to turn into a driveway on the northwest side and was struck midway through the turn by a black sport bike, the affidavit states.

The driver of that sport bike was later identified as David Cunningham, 52. One witness told Eggebrecht that Cunningham went up the road before turning around to provide his name, phone number and insurance company information.

Cunningham then left the scene and the other men weren’t able to get a good look at him because he kept his helmet on, the witness stated.

The injured driver told Eggebrecht he went to Columbus Regional Hospital for back pain. He said he had two fractured vertebrae, a head injury and several abrasions.

Prince’s Lakes Police Department Sergeant Jimmy Coffey reported seeing Cunningham and another man walking in the area of the crash looking near a ditch at around 5:30 p.m., about three hours after the crash.

On May 30, Detective Paul Henderson made contact with Cunningham. Previous attempts to contact and locate him were unsuccessful, according to the probable cause affidavit.

Cunningham told the officer that the crash occurred about an hour and a half earlier than the other men said. He said he had passed a truck when he came upon the three motorcycles. He said one motorcycle turned in front of him, causing him to crash into it, but that he was only going about 5 mph at the time.

He said that he returned to the scene to give his information and he smelled alcohol on the other driver. He said the driver told him he was fine and they exchanged information. Cunningham said he offered to help fix the motorcycle, too, the affidavit states.

Cunningham said both parties decided not to notify police, according to the affidavit.

He was charged July 24 with leaving the scene of an accident with serious bodily injury, a Level 6 felony.
