Police: Driver tested nearly 4 times over legal limit

Police say a Nashville man had almost four times the legal limit of alcohol in his system when he was stopped for driving left of center Dec. 19.

Brown County Sheriff’s Deputy Andrew Eggebrecht stopped Donald A. Hoy Jr., 36, at around 8:45 p.m. on State Road 46, according to the probable cause affidavit.

Eggebrecht reported smelling alcohol on Hoy, that his speech was slurred, his eyes were red, his manual dexterity was poor, that he had an “inconsistent” and “abusive” attitude and that his balance was unsteady.

Eggebrecht also noted that Hoy staggered from his vehicle during the stop, according to the affidavit.

A breath test showed his blood-alcohol content to be 0.29. The legal limit is 0.08. The results of a chemical test still are pending, the affidavit states.

Hoy was charged Dec. 20 with three alcohol-related misdemeanors.
