Police: Pills, syringe, heroin found on man

FRUITDALE — A Lafayette man was charged with felonies and a misdemeanor in Brown County after police reported finding a syringe, heroin and Xanax pills in his possession during a domestic battery investigation on March 9.

Brown County Sheriff’s Deputy William Pool spoke with Colton Spear, 27, in the 400 block of Fruitdale Road, while Spear was in the driver’s seat of a vehicle. Pool reported that Spear kept grabbing at his own ankles. The officer asked Spear to exit the vehicle to continue the investigation and Spear declined to do so until Pool tried to open the driver’s side door, the affidavit states.

Spear said he would get out, but needed to fix his pants first. He began adjusting his shoes and pants, which were unzipped and around his ankles. He began pulling items from his pant legs and dumping them on the car’s floorboard. As Spear was shaking his pant legs, Pool reported seeing a blue baggie containing what he suspected was heroin hit the driver’s side floorboard. That is when Pool took Spear’s arm and helped him from the vehicle, the police report said.

While Spear was exiting the car, a syringe also fell from his pant leg. Spear was then placed under arrest and Pool began searching him.

Spear began shaking out the front pocket of his hooded sweatshirt. Pool reported seeing while pills fall and hit the ground. He was able to determine the pills were Xanax, the affidavit states.

Spear was taken to the Brown County jail. On March 12, he was charged with possession of a narcotic drug and unlawful possession of a syringe, both Level 6 felonies, along with possession of a controlled substance, a Class A misdemeanor.
