Austin Gess, count 1: cruelty to an animal, Class A misdemeanor; count 2: possession of paraphernalia, Class C misdemeanor. Count 1: 365 days in BCJ with 14 days executed, remainder suspended. Count 2: 14 days in BCJ all executed, concurrent to each other. Credit for seven actual days. Probation for 351 days under standard terms and conditions to include additional condition of 50 hours of public service restitution. Probation may terminate early if otherwise in compliance.

Credit for one actual day. Probation for 720 days to commence immediately. As a condition of probation, 720 days to be served on electronic home monitoring through Brown County Community Corrections with a transfer to Marion County. Defendant to submit to DNA testing as directed by probation. Remaining nine actual days of executed sentence to be served on consecutive weekends commencing May 3. Driver’s license suspended for 365 days commencing as determined by the BMV; $386.50 fine and total court costs. Electronic home monitoring to start by May 23.

Skyler Bryant, possession of marijuana, Class B misdemeanor; remaining count dismissed; two days in BCJ, all executed, none suspended. Credit for one actual day. Sentence is served; $386 fine and total court costs.

Mark Morgan, two counts of driving while suspended, Class A misdemeanor; remaining count dismissed. Count 1: 34 days in BCJ, all executed. Count 2: 34 days in BCJ, all executed. Said counts shall run concurrently. Credit for 17 actual days. Executed sentence is served. Probation for 180 days to include special conditions of: Defendant shall not personally possess or use alcohol; submit to substance abuse evaluation and complete all treatment recommendations; and complete 24 hours of public service restitution.
