LEGAL NOTICE OF PUBLIC HEARING

FOR SPECIAL EXCEPTION AREA BOARD OF ZONING APPEALS

Notice is hereby given that the Brown County Board of Zoning Appeals will hold a public hearing on July 25, 2018 at 6:00 p.m. in the second floor meeting room in the County Office Building. The purpose of the meeting is to consider a petition by Michael and Susan Murphy for a Special Exception to allow a Tourist Home.

The location of the property is 7690 State Road 46 East in Washington Township.

Legal description of premises:

A part of the Southwest Quarter of the Southeast Quarter of Section 20, Township 9 North, Range 4 East, lying in Washington Township, Brown County, Indiana, and described as follows:

Commencing at a rebar marking the Northeast comer of the Southwest Quarter of the Southeast Quarter of said Section 20; thence North 89 degrees 55 minutes 28 seconds West (an assumed bearing) along the North line of said Quarter Quarter 725.00 feet to a rebar; thence leaving said North line South 00 degrees 31 minutes 59 seconds West parallel with the East line of said Quarter Quarter 371.25 feet to a rebar and the point of beginning; thence South 29 degrees 53 minutes 24 seconds West a distance of 90.91 feet to a 1/2 inch pinched pipe found and a 1/2 inch pipe found; thence South 32 degrees 38 minutes 39 seconds West a distance of 181.15 feet to a 1/2 inch pipe found; thence South 46 degrees 49 minutes 41 seconds West a distance of 240.38 feet to an Indiana State Highway Commission Right of Way Monument on the North right of way line of State Highway No. 46; thence South 56 degrees 36 minutes 37 seconds East along said right of way 352.83 feet to a rebar and the P.C. of a tangent right of way curve to the left with a radius of 5118.79 feet; thence along said right of way curve an arc distance of 322.57 feet to a rebar, said rebar bearing South 58 degrees 24 minutes 55 seconds East a distance of 322.52 feet from last said rebar; thence leaving said right of way North 08 degrees 10 minutes 00 seconds West a distance of 766.50 feet to a rebar; thence North 89 degrees 55 minutes 28 seconds West parallel with aforesaid North line 142.12 feet to the point of beginning, containing 5.00 acres, more or less.

The file on this matter is available for public inspection 10 days prior to the hearing, during the regular working hours at the Brown County Area Plan Commission office in the County Office Building located at 201 Locust Lane Nashville, Indiana.

All interested persons will be given the opportunity to be heard in reference to the matters set out in the petition. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing, will be considered. The hearing may be continued from time to time.
