Notice is hereby given that the Brown County Area Board of Zoning Appeals will hold a public hearing on May 29, 2019 at 6:00p.m. in the second floor meeting room in the County Office Building. The purpose of the meeting is to consider a petition by Eugenia Nastoff to allow a Home Stay-Home Occupation Special Exception in the residence of the property owner.

The location of the property is 1878 Orchard Hill Road, Nashville in Washington Township.

AN ORDINANCE OF BROWN COUNTY, INDIANA, CREATING A PERFORMING ARTS CENTER ADMISSIONS TAX

WHEREAS, Indiana Code 6-9-46 et seq. (the Performing Arts Center Admissions Tax) authorizes Brown County to impose a performing arts center admissions tax on an indoor performing arts centers; and

WHEREAS, Indiana Code 6-9-46-2 et seq. (the Indoor Performing Arts Center) authorizes an admissions tax on an indoor performing arts center that has a minimum capacity of at least two thousand (2,000) patrons, is located in a geographic area that has not been annexed by a city before the adoption of this ordinance; and

WHEREAS, the County Council, after January 1 but before June 1 of a year, may adopt an ordinance to impose an excise tax for the privilege of attending any event held in an indoor performing arts center; and

WHEREAS, the County Council deems it necessary to now impose the Performing Arts Center Admissions Tax.

NOW, THEREFORE, BE IT AND IT IS HEREBY ORDAINED by the County Council of Brown County, Indiana, as follows:

Performing Arts Center Admissions Tax. The Brown County Council shall implement the Performing Arts Centers Admissions Tax at an excise tax rate of $1.00 for any event held in an indoor performing arts center in Brown County and to which tickets are offered for sale to the public by the box office or an authorized agent.

The excise tax imposed by the County Council does not apply to the following:

  1. An event sponsored by an educational institution or an association representing educational institution.
  2. An event sponsored by a religious organization.
  3. An event sponsored by an organization that is considered a charitable organization by the Internal Revenue Service for federal tax purposes.
  4. An event sponsored by a political organization.

Section 2. Repeal and modification. This Ordinance may be repealed and the rates set forth herein may be decreased only in accordance with the Indiana Code.

Section 3. Publication. The county auditor is hereby directed to file a copy of this ordinance with the Commissioner of the Department of State Revenue as required by law.

Section 4. Conflicting Ordinances. Any ordinance or provision of any Ordinance of Brown County in conflict with the provisions of this Ordinance is hereby repealed.

Section 5. Severability. The invalidity of any section, clause, sentence or provision of this Ordinance shall not affect the validity of any other part of this Ordinance which can be given effect without such invalid part or parts.

Section 6.  Effective Date.  This Ordinance shall be in full force and effect after its passage, approval by the County Council and publication as required by law.
