FOR SPECIAL EXCEPTION AREA BOARD OF ZONING APPEALS

Notice is hereby given that the Brown County Board of Zoning Appeals will hold a public hearing on November 28, 2018 at 6:00 p.m. in the second floor meeting room in the County Office Building. The purpose of the meeting is to consider a petition by Damon Daniels to allow a Special Exception for a Tourist Home.

The location of the property is 444 Dawn Lane in Washington Township.

Legal description of premises:

A part of the Northwest Quarter of the Northwest Quarter of Section 26, Township 9 North, Range 3 East, and a part of the Southwest Quarter of the Southwest Quarter of Section 23, Township 9 North, Range 3 East, Brown County, Indiana, and further described as follows:

Beginning at a point located South 42 degrees 34 minutes East 302.29 feet from the Northwest comer of Section 26, Township 9 North, Range 3 East; thence North 44 degrees 53 minutes East 52.80 feet; thence North 40 degrees 16 minutes East 208.90 feet; thence North 35 degrees 14 minutes East 225.46 feet; thence North 25 degrees 45 minutes East 50.05 feet; thence South 44 degrees 7 minutes East 505.81 feet; thence South 53 degrees 18 minutes West 118.76 feet; thence South 43 degrees 28 minutes West 126.95 feet; thence South 47 degrees 31 minutes West 280.47 feet; thence North 44 degrees 40 minutes West 407.45 feet to the place of beginning, containing 5.34 acres with 0.52 of an acre being in said Section 23 and 4.82 acres being in said Section 26.

A Non-Exclusive Easement for ingress, Egress and utilities over and along an existing 50 foot side roadway, the centerline of which is described as follows: Beginning at the Southeast corner of the parcel of real estate described In Warranty Deed recorded in Deed Record No. 86, pages 432-433, in the Office of the Recorder of Brown County, Indiana; thence North 59 degrees 14 minutes East 109.6 feet, thence South 02 degrees 02 minutes 30 seconds West 200 feet; more or less, to the Lynn Public Road In Deer Traits Subdivision.

A part of the Northwest Quarter of the Northwest Quarter of Section 26, Township 9 North, Range 3 East, Brown County, Indiana, more particularly described as follows:

Commencing at the Northeast corner of the Northwest Quarter of the Northwest Quarter of said Section 26; thence North 86 degrees 57 minutes 27 seconds West along the North line of said Northwest Quarter 389.79 feet to the point of beginning; thence South 09 degrees 52 minutes 00 seconds West 120.34 feet; thence South 59 degrees 14 minutes 00 seconds West 79.90 feet; thence North 44 degrees 18 minutes 03 seconds West 241.95 feet; to the North line of said Northwest Quarter, thence South 86 degrees 57 minutes 27 seconds East along said North line 258.62 feet to the point of beginning, containing 0.57 acres, more or less.

The file on this matter is available for public inspection 10 days prior to the hearing, during the regular working hours at the Brown County Area Plan Commission office in the County Office Building located at 201 Locust Lane Nashville, Indiana.

All interested persons will be given the opportunity to be heard in reference to the matters set out in the petition. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing, will be considered. The hearing may be continued from time to time.
