STATE OF INDIANA, IN THE CIRCUIT COURT OF BROWN COUNTY, COUNTY OF BROWN

CAUSE NUMBER 07C01-1902-GU-000003

IN THE MATTER OF THE GUARDIANSHIP OF

AYDAN SKY ANDERSON and ZOEY JAYNE ANDERSON, MINOR CHILDREN.

CARL E.DENNIN and MARY J. DENNIN, Petitioners.

NOTICE BY PUBLICATION TO FATHER AND OTHER INTERESTED PERSONS RELATED BY BLOOD OR MARRIAGE

Robert Elias Anderson, who is the father of the children named Aydan Sky Anderson (DOB 12/31/07) and Zoey Jayne Anderson (DOB 10/07/09), and all interested persons related by blood or marriage are notified that a petition for guardianship of the children was filed by Carl E. Dennin and Mary J. Dennin in the office of the Clerk of the Circuit Court of Brown County, Courthouse, P.O. Box 85, Nashville, Indiana 47448.

On April 16,2019, at 3:00 p.m. in the Circuit Court of Brown County, Indiana, a hearing will be held to determine whether guardians should be appointed or a protective order should be issued for Aydan Sky Anderson and Zoey Jayne Anderson. The purpose of this proceeding is to protect the persons and estates of Aydan Sky Anderson and Zoey Jayne Anderson. A copy of the petition requesting appointment of guardians or for the issuance of a protective order is available in the office of the Clerk of the Circuit Court of Brown County. At the hearing the court will determine whether Aydan Sky Anderson and Zoey Jayne Anderson are incapacitated persons under Indiana law by reason of their minority.

If the Court finds that Aydan Sky Anderson and Zoey Jayne Anderson are incapacitated persons or minors, the Court at the hearing shall also consider whether Carl E. Dennin and Mary J. Dennin should be appointed as guardians of Aydan Sky Anderson and Zoey Jayne Anderson. The Court may, in its discretion, appoint some other qualified person as guardian. The Court may also, in its discretion, limit the powers and duties of the guardians to allow Aydan Sky Anderson and Zoey Jayne Anderson to retain control over certain property and activities. The Court may also determine whether a protective order should be entered on behalf of Aydan Sky Anderson and Zoey Jayne Anderson.

Aydan Sky Anderson and Zoey Jayne Anderson may attend the hearing and be represented by an attorney. The petition may be heard and determined in the absence of Aydan Sky Anderson and Zoey Jayne Anderson if the Court determines that the presence of Aydan Sky Anderson and Zoey Jayne Anderson is not required. If Aydan Sky Anderson and Zoey Jayne Anderson attend the hearing, oppose the petition, and are not represented by an attorney, the Court may appoint an attorney to represent the alleged incapacitated persons or minors. The Court may, where required, appoint a guardian ad litem to represent Aydan Sky Anderson and Zoey Jayne Anderson at the hearing.

The Court may, on its own motion or on request of any interested person, postpone the hearing to another date and time.

If Robert Elias Anderson or any other interested person related by blood or marriage seeks to contest the guardianship of the child, that person or that person’s attorney must respond to the allegations within 30 days after the last publication of this notice, and if that person fails to do so, judgment by default may be entered against that person for the relief demanded in the petition for guardianship.
