Plan Commission public hearing RE: Flood plain/Flood hazard area regulations change and replacement

NOTICE OF PUBLIC HEARING AND MEETING ON ZONING ORDINANCE AMENDMENTS

Please take notice that the Brown County Area Plan Commission will conduct a public hearing and meeting on Tuesday, September 27,2016, at 6:00 o’clock p.m., in the Salmon Meeting Room on the Second Floor of the Brown County Government Annex Building, 201 Locust Lane, Nashville, Indiana.   The purpose of the hearing and meeting shall be: to accept public comment on proposed amendments (” the amendments”) to the Brown County Zoning Ordinance Flood Plain Management regulations (Chapter 10) and on the Town of Nashville Zoning Ordinance Flood Hazard Area regulations (Chapter 151, Town of Nashville Code of Ordinance) that would affect both the text and maps related to those regulations; and to take other actions deemed appropriate, including the approval, the revision, or the rejection of the amendments.   The amendments are based on a model ordinance form prepared for and approved by the Indiana Department of Natural Resources, Division of Water.

If adopted, the amendments would, generally speaking, comprehensively replace the current flood plain and flood hazard area regulations.   Specifically, the amendments would:   add or amend the definitions of A Zone, Accessory Structure, Addition, Appeal, Area of Shallow Flooding, Base Flood, Base Flood Elevation (BFE), Basement, Boundary River, Boundary River Floodway, Community, Community Rating System (CRS), Critical Facility, D Zone, Elevated Structure, Elevation Certificate, Emergency Program, Flood Boundary and Floodway Map (FBFM), Flood Insurance Rate Map (FIRM), Flood Insurance Study (FIS), Flood Prone Area, Flood Protection Grade (FPG), Flood Plain Management, Flood Plain Management Regulations, Floodproofing (dry floodproofing), Floodproofing Certificate, Freeboard, Fringe, Hardship, Highest Adjacent Grade, Historic Structures, Increased Cost of Compliance (ICC), Letter of Final Determination (LFD), Letter of Map Change (LOMC), Letter of Map Amendment (LOMA), Letter of Map Revision Based on Fill (LOMR-F), Lowest Adjacent Grade, Lowest Floor, Manufactured Home Park or Subdivision, Market Value, Mitigation, National Flood Insurance Program (NFIP), National Geodetic Vertical Datum (NGVD) of 1929, New Construction, Non-boundary River Floodway, North American Vertical Datum of 1988 (NAVD 88), Obstruction, One-percent Annual Chance Flood, Physical Map Revision (PMR), Public Safety and Nuisance, Regular Program, Regulatory Flood, Repetitive Loss, Section 1316, Special Flood Hazard Area (SFHA), Start of Construction, Substantial Damage, Substantial Improvement, Suspension, Variance, Violation, Watercourse, X Zone, Zone, Zone A, and Zone B, C, and X; remove the Flood Hazard Boundary Map definition from the County and Nashville regulations; remove the Flood Proofed Building and Regulatory Flood Profile Definitions from the County regulations; amend or add statutory authorization, findings of fact, statement of purpose, and objectives sections; to the general provisions, add or amend sections relating to scope, basis for establishing regulatory flood data, establishment of floodplain development permit, compliance, abrogation and greater restrictions, discrepancy between mapped floodplain and actual ground elevations, interpretation, warning and disclaimer of liability, and, penalties for violation; to the administration provisions, add or amend sections relating to designation of the administrator, permit procedures, and, duties and responsibilities of the floodplain administrator; to the flood hazard reduction provisions, add or amend sections relating to general standards, specific standards, standards for subdivision proposals, critical facilities, standards for identified floodways, standards for identified fringe, standards for SFHAs without established base flood elevations and/or floodways/fringes, and, standards for flood prone areas; to the variance procedures provisions, add or amend sections relating to designation of variance and appeals board, duties of variance and appeals board, variance procedures, conditions for variances, variance notification, historic structures, and special conditions; and severability and effective date language.

If adopted, the amendments would rezone certain parcels of property to reflect the adoption of the Flood Insurance Study of Brown County, Indiana, and Incorporated Areas, and the corresponding Flood Insurance Rate Map dated December 8, 2016 as the flood plain/flood hazard area zoning maps for the County and Nashville.

Copies of the proposed amendments, including the maps, are available in the Brown County Planning Department, 201 Locust Lane, Nashville, Indiana 47448.   During the hearing, oral objections or comments concerning the proposed amendments will be heard.   Written objections or comments that are filed with Brown County Planning Director Christine Ritzmann, at the Brown County Planning Department, prior to the time of the hearing, will be considered by the Brown County Area Plan Commission.   The hearing may be continued from time to time as may be found necessary.
