A Bloomington man has been charged with two misdemeanors after an officer who pulled him over reported seeing an alcoholic beverage bottle between his legs.

Nashville Police Officer Kyle Seward stopped Floyd T. Davis, 41, in the 6400 block of State Road 46 East, in the area of Hoover Road. Seward wrote in a report dated July 28 that Davis failed to dim his headlights and a check of his license showed he was driving while suspended.

When Seward spoke with Davis, he reported that he smelled of alcohol, his speech was slurred, his eyes were red and watery and his balance was unsteady. Seward also wrote that Davis had an “abusive attitude” and that an alcoholic beverage container was in plain view in the vehicle.

A blood test taken at Columbus Regional Hospital about three hours after his arrest showed he had an alcohol concentration of 0.115, over the legal limit of 0.08, the report said.

He was charged in Brown Circuit Court Dec. 15.
