BROWN COUNTY BOARD OF ZONING APPEALS

FOR MCQUEARY TOURIST HOME

Notice is hereby given that the Brown County Board of Zoning Appeals will hold a public hearing on March 1, 2017 at 6:00 p.m. in the second floor meeting room in the County Office Building. The purpose of the meeting is to consider a petition by Rae A. McQueary for a Special Exception to allow a tourist home.

The location of the property is 1651 Jackson Branch Ridge Road in Jackson township.

Legal description of premises:

Part of the Southwest quarter of the Southeast quarter of Section 11, Township 9 North, Range 2 East, Jackson Township, and part of the Northwest quarter of the Northeast quarter of Section 14, Township 9 North, Range 2 East, Washington Township, all in Brown county, Indiana, described as follows:

Beginning at a stone found marking the Southeast corner of the Southwest quarter of the Southeast quarter of said Section 11, also being the Northeast corner of the Northwest quarter of the Northeast quarter of said Section 14; thence South 01 degree 45 minutes West (assumed bearing) with the East line of said Northwest quarter of the Northeast quarter 123.8 feet to a capped rebar set; thence North 83 degrees 28 minutes West 982.9 feet to an iron pipe found; thence North 06 degrees 32 minutes East 238.4 feet to an iron pin found in the center of Jackson Branch Ridge County Road; thence with said County Road: North 78 degrees 26 minutes East 96.3 feet to an iron pin set. South 89 degrees 03 minutes East 59.4 feet to an iron pin set, South 74 degrees 32 minutes East 62.5 feet to an iron pin set, South 64 degrees 37 minutes East 143.9 feet to an iron pin set. South 66 degrees 07 minutes East 80.9 feet to an iron pin set. South 74 degrees 59 minutes East 111.2 feet to an iron pin set, South 81 degrees 03 minutes East 140.2 feet to an iron pin set and South 81 degrees 18 minutes East 293.3 feet to an iron pin found in the East line of said Southwest quarter of the Southeast quarter; thence South 00 degrees 54 minutes West with said East line 37.2 feet to the beginning, containing 4.57 acres, more or less.

With the exception of any condition, covenant or restriction based on race, color, religion, sex, handicap, familial status, or national origin unless and only to the extent that said covenant (a) is exempt under Chapter 42, Section 3607 of the United State Code, or (b) relates to handicap, but does not discriminate against handicapped persons, the above described real estate is subject to an Easement for water lines and incidental purposes granted to Brown County Water Utility, Inc., its successors and assigns, dated April 27, 2007 and recorded July 31, 2007 as Instrument No. 2007-2655, in the Office of the Recorder of Brown County, Indiana, and to all other valid easements, restrictions, roadways and rights of way of record.

The file on this matter is available for public inspection 10 days prior to the hearing, during the regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana.

All interested persons will be given the opportunity to be heard in reference to the matters set out in the petition. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing, will be considered. The hearing may be continued from time to time.
