Nashville man faces child porn charges

A 37-year-old Nashville man is facing child pornography charges after police say text messages and emails showed he was in a relationship with a 17-year-old.

Ross A. Volbrecht, of Artist Drive, was booked into the Brown County jail on a warrant July 27. He was released about an hour later after posting $2,500 bond.

The investigation began in January, according to a probable cause affidavit by Brown County Sheriff’s Detective Brian Shrader.

The girl’s mother notified police after looking through her daughter’s cellphone. She told police her daughter had just turned 17.

Shrader took 267 photos of messages and pictures sent between the girl and Volbrecht, his report said. He wrote that it was evident the two had both a physical and emotional relationship. Some messages also discussed including using drugs together.

The first messages were dated in November 2016 when the girl was 16, the affidavit said.

One of the first was the girl asking to sneak over to Volbrecht’s house, but he told her he was going to sleep, the affidavit said. Later that week, the two exchanged text messages about using “go,” which Shrader said is a slang term for methamphetamine, and the girl spending the night with Volbrecht.

More messages about using methamphetamine, opiates and prescription drugs were exchanged throughout December, the report said.

The girl sent several nude images to Volbrecht, and Volbrecht appeared to have forwarded some from his phone to his email account over several months, the report said.

Volbrecht was on probation for possessing a device or substance used to interfere with a drug or alcohol screening test. Shrader forwarded this case, including messages about Volbrecht using drugs, to the Brown County Probation department. At a hearing Jan. 24, Volbrecht admitted to the probation violation and was sentenced to serve his remaining 176 days on electronic home monitoring, according to online court documents.

In a police interview in January, he admitted to being in a relationship and having sex with the girl, Shrader’s report said. He told police he had not shown the photos to anyone.

He also admitted to sending nude photos of himself to the girl, the affidavit states.

The girl told police the two had been romantically involved for a few months, that she had pursued Volbrecht and that she willingly sent him the nude photos.

She described their relationship as “boyfriend and girlfriend,” but she said she hid it due to her age, the affidavit states.

A condition of his bond is to have no contact with the girl. He was scheduled to appear in court Aug. 8, but attorney Katharine Liell filed an appearance on his behalf Aug. 7 and his initial hearing was waived, according to online court documents.

On July 26, he was charged with possession of child pornography, a Level 6 felony, and contributing to the delinquency of a minor, Class A misdemeanor.

Volbrecht was not charged for having a physical relationship with the girl because the age of consent in Indiana is 16, Prosecutor Ted Adams said. In cases in which the adult is in a position of trust — such as a coach or caregiver — that law would have applied differently.
