Man arrested on felony charge after domestic dispute

BEAN BLOSSOM — A Brown County man is facing a felony charge for resisting law enforcement after police say he left the scene of a dispute, then crashed his vehicle and left the crash scene.

Brown County Sheriff’s Deputy Colton Magner was on patrol the evening of Aug. 28 when he stopped at the intersection of State Road 45 and North State Road 135 and heard a woman screaming “stop” from the Dollar General parking lot, a probable cause affidavit states.

A woman was standing the parking lot, waving at him. A dark vehicle at the west end of the lot turned its headlights on and approached his police vehicle, the affidavit states.

Magner recognized the driver as Joseph Fowler, 22, of State Road 45.

Magner got out to talk with the woman. She told him she had a protective order against Fowler, but he had come to her house and broken her phone.

Before Magner could talk to Fowler, he revved his engine and left the parking lot at a high rate of speed and turned onto Gatesville Road, the report said.

Magner and Bowling were later dispatched to a property-damage crash near the area where they had lost sight of Fowler. The driver had left the scene, but it was the same vehicle Magner had seen at the Dollar General, his report said. It had missed a curve in the 1100 block, hit a utility pole and broken it. Contents of the car were spread over the road from the impact, the police report said.

Magner went to the woman’s apartment to interview her. She said she had invited Fowler over for dinner, and he saw messages from another man on her cellphone. She said Fowler broke a wine glass during an argument and she attempted to call for help, but Fowler broke her phone.

He left in his vehicle and parked in the Dollar General parking lot. She walked over to the parking lot to try and get her phone and keys back, which is when she flagged down Magner, the affidavit states.

Magner took the woman to a relative’s house for the night.

Fowler was charged Sept. 8 with resisting law enforcement, a Level 6 felony; interference with the reporting of a crime, a Class A misdemeanor; invasion of privacy, a Class A misdemeanor; and leaving the scene of an accident, a Class B misdemeanor. A warrant was issued for his arrest Sept. 13.
