AREA BOARD OF ZONING APPEALS

Notice is hereby given that the Brown County Board of Zoning Appeals will hold a public hearing on April 25, 2018 at 6:00 p.m. in the second floor meeting room in the County Office Building. The purpose of the meeting is to consider a petition by Brian and Darla Fenneman/The Old Barn at Brown County for a Special Exception to allow an extension of time period to meet conditions set for the Private Recreational Development.

The location of the property is 3016 Hoover Rd. in Hamblen Township.

Legal description of premises:

ALSO Part of the Southwest Quarter of the Southwest Quarter and part of the Southeast Quarter of the Southwest Quarter of Section 4, Township 9 North, Range 4 East of the Second Principal Meridian, Hamblen Township, Brown County, Indiana described as follows: Commencing at a concrete monument found marking the northwest corner of the Southwest Quarter of the Southwest Quarter of said Section 4; thence South 89 degrees 01 minutes 06 seconds East (bearing from deed) on and along the North line of said Southwest Quarter, Southwest Quarter 667.44 feet to a concrete monument found; thence South 04 degrees 26 minutes 06 seconds East 259.13 feet to a concrete monument found; thence South 65 degrees 54 minutes 30 seconds East 1201.62 feet to a 2 inch mag nail with aluminum disc (stamped Bennett S0438) set over a 5/8 inch rod found in the center of Hoover county road; thence the following two (2) courses are with the center of said county road: South 18 degrees 09 minutes 11 seconds West 160.01 feet to a railroad spike found and South 32 degrees 05 minutes 43 seconds West 167.01 feet to a 2 inch mag nail with aluminum disc (stamped Bennett S0438) set over a railroad spike found and the beginning; thence continuing with the center of said county road the following five (5) courses: South 43 degrees 32 minutes 37 seconds West 200.89 feet to a railroad spike found; South 61 degrees 27 minutes 23 seconds West 121.98 feet to a railroad spike found; South 77 degrees 04 minutes 47 seconds West 92.90 feet to a railroad spike found; South 63 degrees 15 minutes 02 seconds West 116.95 feet to a railroad spike found; and South 54 degrees 48 minutes 05 seconds West 23.00 feet to a 2 inch mag nail with aluminum disc (stamped Bennett S0438) set over a railroad spike found; thence leaving the center of said county road North 64 degrees 54 minutes 22 seconds West 720.00 feet to a 5/8 inch capped rebar (stamped Bennett S0438) set passing through a concrete monument found at 28.80 feet; thence North 25 degrees 05 minutes 38 seconds East 360.00 feet to a 5/8 inch capped rebar (stamped Bennett S0438) set; thence South 90 degrees 00 minutes 00 seconds East 630.00 feet to a 5/8 inch capped rebar (stamped Bennett S0438) set; thence South 43 degrees 57 minutes 47 seconds East 473.48 feet to the beginning, containing 10.733 acres more or less.

The file on this matter is available for public inspection 10 days prior to the hearing, during the regular working hours at the Brown County Area Plan Commission office in the County Office Building at 201 Locust Lane in Nashville, Indiana.

All interested persons will be given the opportunity to be heard in reference to the matters set out in the petition. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing, will be considered. The hearing may be continued from time to time.
