LEGAL NOTICE OF PUBLIC HEARING

FOR SPECIAL EXCEPTION AREA BOARD OF ZONING APPEALS

Notice is hereby given that the Brown County Board of Zoning Appeals will hold a public hearing on August 29, 2018 at 6:00 p.m. in the second floor meeting room in the County Office Building. The purpose of the meeting is to consider a petition by Brent and Teresa Burke for a Special Exception to allow a Tourist Home.

The location of the property is 2763 State Road 135 South in Van Buren Township.

Legal description of premises:

A part of the Northwest quarter of the Southeast quarter of Section 3, Township 8 North, Range 3 East, described as follows: Beginning at the Northeast corner of said quarter quarter; thence South with the East line of said quarter quarter 1353 feet to the Southeast corner of said quarter quarter; thence West 681.25 feet to an iron pin; thence West to the centerline of State Road No. 135; thence Northwesterly with the centerline of State Road No. 135,170.5 feet; thence South 89 degrees 40 minutes East 655.3 feet; thence North 26 degrees 44 minutes West 1347.4 feet; thence East with the North line of said quarter quarter 835.27 feet to the beginning. Containing 19.5 acres, more or less.

Also, a part of the Northwest quarter of the Southeast quarter and a part of the Northeast quarter of the Southwest quarter of Section 3, Township 8 North, Range 3 East, Brown County, Indiana, further described as follows: Beginning in the center of State Road No. 135 South 88 degrees 3 minutes West 116.98 feet from the Northwest corner of the Northwest quarter of the Southeast quarter of Section 3, Township 8 North, Range 3 East; thence running North 88 degrees 3 minutes East 647.81 feet; thence South 26 degrees 44 minutes East 1343.04 feet; thence North 89 degrees 40 minutes West 652.32 feet to the center of State Road No. 135; thence following said State Road North 25 degrees 50 minutes West 216.06 feet; thence North 28 degrees 21 minutes 40 seconds West 955.44 feet; thence North 20 degrees 44 minutes West 147.96 feet to the place of beginning. Containing 17.98 acres, more or less.

Except therefrom 5 1/2 acres by parallel lines off of the North end of the above described parcel as conveyed to Karen Lee Pittman by Warranty Deed dated August 10,1983 and recorded August 10, 1983 in Deed Record No. 125 on page 429, in the office of the Recorder of Brown County, Indiana.

Also, except therefrom 0.41 acre, more or less, as conveyed to Gregory D. Pittman and Cindy J. Pittman, husband and wife, and Bradley L. Pittman, an adult man, by Warranty Deed dated December 7,1989 and recorded December 15,1989 in Deed Record No. 144, page 484, in the office of the Recorder of Brown County, Indiana.

Also, except therefrom 8.43 acres, more or less, as conveyed to William F. Farmer and Patricia L. Farmer, husband and wife, by Warranty Deed dated December 11,1991 and recorded December 12, 1991, in Deed Record No. 151 on pages 164-166, in the office of the Recorder of Brown County, Indiana; leaving herein described 3.64 acres, more or less.

Also, a Non-exclusive 20-foot wide Easement located in the Northwest quarter of the Southeast quarter of Section 3, Township 8 North, Range 3 East, the centerline of which is described as follows: Beginning West 835.27 feet, and South 26 degrees 44 minutes East 1020.0 feet from the Northeast corner of said quarter quarter section; thence South 50 degrees 20 minutes West 63.5 feet; South 45 degrees 12 minutes West 158.9 feet; South 65 degrees 13 minutes West 72.4 feet; South 81 degrees 53 minutes West 110.7 feet; North 83 degrees 04 minutes West 90.0 feet; North 68 degrees 57 minutes West 76.0 feet; North 44 degrees 36 minutes West 117.7 feet; and South 74 degrees 05 minutes West 27.7 feet to the center of State Road No. 135.

The file on this matter is available for public inspection 10 days prior to the hearing, during the regular working hours at the Brown County Area Plan Commission office in the County Office Building located at 201 Locust Lane Nashville, Indiana.

All interested persons will be given the opportunity to be heard in reference to the matters set out in the petition. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing, will be considered. The hearing may be continued from time to time.
