LEGAL NOTICE OF PUBLIC HEARING VARIANCE
BROWN COUNTY AREA BOARD OF ZONING APPEALS

Notice is hereby given that the Brown County Area Board of Zoning Appeals will hold a public hearing on December 19, 2018 at 6:00 p.m. in the second floor meeting room in the County Office Building. The purpose of the meeting is to consider a petition by Lloyd and Crystal Wagler for approval of an application for a Variance to allow an undersized parcel.
Legal description of premises:
Part of the Northeast quarter of the Southeast quarter and part of the Southeast quarter of the Southeast quarter of Section 25, Township 10 North, Range 3 East of the Second Principal Meridian; and part of the fractional Northwest quarter of the Southwest quarter of Section 30, Township 10 North, Range 4 East of the Second Principal Meridian, all in Hamblen Township, Brown County, Indiana, described as follows:
Commencing at a % inch rebar found marking the Southwest corner of the Southeast quarter of the Southeast quarter of said Section 25; thence North 00 degrees 00 minutes 00 seconds East (bearing from deed) on and along the West line of said Southeast quarter of the Southeast quarter 343.86 feet to a 1/2 inch rebar found; thence North 88 degrees 33 minutes 18 seconds East 172.82 feet to a point in a grated bridge in the center of
Sweetwater Trail County Road and the beginning; thence the following six (6) courses are with the center of said County Road: North 19 degrees 55 minutes 02 seconds East 191.91 feet to a 2 inch mag nail with aluminum disc (stamped Bennett S0438) set, North 19 degrees 20 minutes 56 seconds East 235.01 feet, North 22 degrees 56 minutes 28 seconds East 72.10 feet, North 25 degrees 51 minutes 43 seconds East 80.47 feet to a 2 inch mag nail with aluminum disc (stamped Bennett S0438) set, North 28 degrees 37 minutes 16 seconds East 422.60 feet and North 24 degrees 46 minutes 09 seconds East 750.30 feet to a 2 inch mag nail with aluminum disc (stamped Bennett S0438) set over a rebar found; thence leaving the center of said County Road North 88 degrees 49 minutes 58 seconds East 425.90 feet to a 5/8 inch rebar found; thence North 89 degrees 14 minutes 21 seconds East 199.65 feet to a chiseled out “L” on a concrete bridge over the center of Sweetwater Creek; thence the following three (3) courses are with the center of said Creek: South 16 degrees 44 minutes 26 seconds West 418.39 feet, South 19 degrees 44 minutes 26 seconds West 198.00 feet and South 43 degrees 59 minutes 26 seconds West 218.46 feet; thence leaving the center of said Creek South 13 degrees 14 minutes
30 seconds West 704.88 feet to a 5/8 inch capped rebar (stamped Bennett S0438) set, passing through a % inch (inside diameter) iron pipe found at 15.87 feet and a 1-1/4 inch (inside diameter) iron pipe found at 701.37 feet; thence South 88 degrees 33 minutes 18 seconds West 705.17 feet to the beginning, passing through a 5/8 inch capped rebar (stamped Bennett S0438) set at 655.17 feet, containing 24.016 acres, more or less.
The property is located at 5141 Sweetwater Trail in Hamblen Township.
The file on this matter is available for public inspection 10 days prior to the hearing, during regular working hours at the Brown County Area Plan Commission office in the County Office Building located at 201 Locust Lane Nashville, Indiana.
All interested persons will be given the opportunity to be heard in reference to the matters set out in the application. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing, will be considered. The hearing may be continued from time to time.
