AN ORDINANCE OF THE BOARD OF COMMISSIONERS OF BROWN COUNTY, INDIANA FOR REAL PROPERTY ENDORSEMENT FEE

WHEREAS, Brown County, Indiana, determines to adopt an Ordinance for a document

Endorsement fee pursuant to I.C. 36-2-9-18;

WHEREAS, The Board of Commissioners of Brown County, Indiana authorize the Brown County

Auditor to collect a fee of ten dollars ($10.00) for each: legal description of each parcel contained in the deed; for which the Auditor makes a real property endorsement;

WHEREAS, the definition of deed is stated as follows: “a signed and usually sealed instrument containing some legal transfer, bargain or contract”;

WHEREAS, said fee is effective July 1, 2019 and is in addition to any other fee provided by law;

WHEREAS, the Auditor shall place the revenue received under this Ordinance in a County fund dedicated for use in maintaining plat books; and

WHEREAS, all previous ordinances regarding endorsement fees are null and void

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONER OF

NOTICE OF FILING OF PETITION FOR APPOINTMENT OF GUARDIAN AND HEARING THEREON

On the 2nd day of August 2019, at  3 p.m. o’clock, in the Circuit Court of Brown County, Nashville, Indiana, a hearing will be held to determine whether a guardian should be appointed for Devon Scott Horton. At the hearing the Court will determine whether Devon Scott Horton is an incapacitated person or minor under Indiana law.

If the Court finds that Devon Scott Horton is an incapacitated person or minor, the Court at the hearing shall also consider whether Donald Kirts and Crescentia Kirts should be appointed as guardians of Devon Scott Horton. The Court may, in its discretion, appoint some other qualified person as guardian. The Court may also, in its discretion, limit the powers and duties of the guardian to allow Devon Scott Horton to retain control over certain property and activities. The Court may also determine whether a protective order should be entered on behalf of Devon Scott Horton.

Devon Scott Horton may attend the hearing and be represented by an attorney. The petition may be heard and determined in the absence of Devon Scott Horton if the Court determines that the presence of Devon Scott Horton is not required. If Devon Scott Horton attends the hearing, opposes the petition, and is not represented by an attorney, the Court may appoint an attorney to represent Devon Scott Horton. The Court may, where required, appoint a guardian ad litem to represent Devon Scott Horton at the hearing another date and time.
