Local man charged with felony for failure to return

A Brown County man faces a charge of failure to return to lawful detention.

On April 22, Emmett S. Smith, 24, was released from the Brown County jail to attend inpatient treatment per a court order. He ended up being administratively discharged from the program for his conduct and rules violations, according to a police report. He was told to return to the jail.

Smith reportedly left the treatment center and did not go back to the jail. When a relative was contacted by a probation officer, she reported that Smith was upset and wanted to go to her house to clean up and eat before returning to the jail. She was told that Smith was to proceed to the jail immediately, the police report said.

As of May 12, Smith still had not returned to the jail, the police report said. Capt. Mike Moore requested a warrant for escape and failure to return to lawful detention. Smith was formally charged with a Level 6 felony.
