Man arrested on suspicion of DWI

A Nashville man faces charges for driving while intoxicated after police stopped him for speeding on State Road 46 West May 9.

Benjamin G. Herr, 26, was stopped by Nashville Police Officer Michael Williams for speeding at around 10:30 p.m. near Town Hill Road, according to a probable cause affidavit.

Williams reported smelling alcohol on Herr, that his balance was unsteady and he almost fell during the traffic stop. A breath test showed his blood-alcohol content to be 0.09, over the legal limit of 0.08, the affidavit states.

Herr was charged May 11 with misdemeanors, one for operating a vehicle while intoxicated and one for possession of paraphernalia. The police report did not provide details as to why Herr was charged with possession of paraphernalia.
